What is the status of my American Superior insurance policy?
Pursuant to the terms of the liquidation order and Section 631.252, Florida Statutes,
your insurance coverage with American Superior Insurance Company was cancelled effective January 14, 2005 at
11:59 P.M. E.S.T. unless cancelled at an earlier date. Policies with a normal expiration date, or those policies
that are cancelled for non-payment of premium prior to 11:59 PM on January 14,
2005 shall stand cancelled as of the earlier date and time.
When I am getting my return premium refund?
The Receiver has completed the process of auditing and calculating over 87,000 premium refunds. If your return
premium calculation exceeded $100, The Florida Insurance Guaranty Association
(FIGA (you are leaving the DFS website and opening a new browser window)) should have processed and mailed you a return premium check
less the $100 deductible allowed by statute.
I am owed a return premium refund but have not received a check. What
do I do?
Return premium checks have been mailed to all known policyholders that
were owed return premium exceeded $100. If you feel you
are owed a return premium check but have not received one or if you have other questions
about the status of your return premium claim, you may contact the Receiver at

How do I file a claim for my $100 deductible or return premium claim of $100
or less?
In order to file a claim for your $100 deductible (or refund claim of $100 or less), you must submit a proof of claim form to the Receiver.
On June 8, 2005, the Receiver mailed notices (a postcard) to eligible recipients explaining how to obtain a proof of claim form. If you
have not received a postcard and would like a return premium proof of claim form, please contact the Receiver by using the Customer Inquiry form located in the
"Contact Us" area of our website. Alternatively, you may contact the Receiver at 850-413-3081

When is the deadline for filing a proof-of-claim for the $100 deductible or for
return premium claims of $100 or less?
All claims against the estate of American Superior must be filed by December 1, 2005 to be considered timely filed.
What if my proof of claim form is filed after the 12/1/05 filing deadline?
Any proof of claim form postmarked after December 1, 2005 will be processed as “late-filed”. “Late-filed” claims are assigned a lower payment priority.
If I believe my proof-of-claim should be considered timely filed, what should I do?
If you believe that your proof of claim form should be considered timely-filed, you may submit your request for the Receiver to accept your proof of claim form as timely-filed. With appropriate supporting documentation, Chapter 631, Florida Statutes gives you the right to petition the receivership court (Second Judicial Circuit, Tallahassee, Leon County, Florida, case number 04-CA-2353) to accept your claim as timely-filed.
When will I receive payment of my $100 deductible or return premium or $100 or
less from the estate of American Superior?
The receivership process is lengthy and typically takes several years to complete. Your claim may be paid on a pro-rata basis, to be determined by available funds, after all legal and collection activity has ceased.
