COMPTROLLER'S MEMORANDUM NO. 06 (1995-96)
SUBJECT: MOTOR VEHICLE IMPACT FEE REFUNDS
Note: This Comptroller's Memorandum was not issued as a draft due to
time constraints. However, if recipients have issues that will
substantially change this information, please contact me as soon
as possible.
The Supreme Court has ruled on the
outstanding issues regarding the motor vehicle impact fee refunds.
The Department of Highway Safety and Motor Vehicles (DHSMV) is
preparing to submit the first payment tape to this office for
processing.
As indicated in Comptroller's Memorandum
No. 23 (1994-95), each agency is required to obtain from DHSMV
a file or listing of persons eligible to receive the refunds,
and to provide the Comptroller with information concerning debts
owed to the State and delinquent child support obligations by
persons authorized to receive impact fee refunds. Further,
if an agency does not report any debts or obligations to this
office, we will proceed with processing the refunds under the
assumption that the agency has no outstanding debts or obligations
that should be reported for this purpose.
We have received files of debts and
obligations from some agencies. Due to the time that has elapsed
since the initial submissions, we would like to give agencies
an opportunity to submit updated files, or initial files if no
files have been submitted, before we begin processing the refunds.
However, if an agency is submitting an updated file, it should
be submitted as a replacement of the first file submitted,
as the information in the first file will not be processed. If
an updated file is not submitted, we will process the first file.
All files of debts and obligations must be received by this office
by October 26, 1995. The files should be submitted to:

Agencies should refer to Comptroller's
Memorandum No. 23 (1994-95) regarding notices that will be given
to persons who owe debts or obligations, and other procedures
applicable to processing these refunds. The General Counsel of
each agency will be furnished a list of persons have
been provided notices of right to a hearing regarding the proposed
deduction for the debt or obligations. Questions regarding these

The first payment tape should be
submitted to this office by the DHSMV within the next week. At
a later date, DHSMV will submit a final payment tape, containing
the refunds processed and authorized after the first submission.
Agencies will again be given the opportunity to submit updated
debt and obligation files prior to our processing the final payment
tape.
