The Legislature created The Florida Clerks of Court Operations Corporation (CCOC) for establishing a process for the review and certification of proposed court-related budgets submitted by each Clerk of the Circuit Court.  The CCOC is responsible for making recommendations to the Legislature for changes in various court-related fines, fees, service charges and court costs established by law to ensure adequate funding of the Clerks of the Court in the performance of court-related functions as prescribed in Section 28.35(2)(c), Florida Statutes (F.S.).

The Article V Section performs on-site budget reviews for the 67 Clerk’s Offices to ensure that Clerk’s budgeting practices and expenditure and revenue methodologies for State funds are accurately recorded, upon certification of court-related budgets.  Each county is monitored for compliance of the established performance standards for measure on fiscal management, operational efficiency and effective collections of fines, fees, service charges and court costs as prescribed in Section 28.36(6)(a), F.S.  The Article V Section publishes a Budget Review Report that details the scope, objectives and methodology used by the clerks for managing the budget, after each review.

All Clerks certified as a surplus county shall remit one-third of all fines, fees, service charges and costs collected by clerks of the court during the prior month for the performance of court-related functions to the Department of Revenue for deposit to the Clerks of the Court Trust Fund, pursuant to Section 28.37, F.S.  The Department of Revenue will make monthly transfers to Clerks that are certified as budgeted deficit counties.  Each Clerk shall remit all cumulative excess funds to the Department of Revenue for deposit in the General Revenue Fund on or before January 1st for the prior fiscal year.
